There is a hard line near the water. Coastal construction is prohibited within 50 feet of the line of mean high water except by waiver or variance under Section 161.052, so on a deep beachfront lot the pool's position may be decided by that rule before anything else.
Not every oceanfront property is caught. Structures well landward of the dune system can go through a streamlined thirty-day permit, and general permit lines exist along many beaches to establish eligibility quickly.
